Welcome! Thank you for choosing Executive Performance Coaching to meet your health and wellbeing goals.

The purpose of the contractual agreement below is to make your XPC Journey a smooth process - and allow us to concentrate on what we do best - coaching you to achieve life changing results.

By embarking on our coaching services you agree to the following terms: embarking on services is defined by securing a space on our coaching programme with either the Head Coach or a member of the team. Securing your coaching space is confirmed upon receipt of payment for either a single payment or subscription. Unless otherwise agreed this will be done securely through Stripe.

Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties."

Purpose of the Agreement

Welcome! We are looking forward to working with you. Please read this information carefully. The purpose of this Agreement is to set forth the details about working together so that we both have a clear understanding of the conditions and our respective responsibilities.

Contractual Agreement:

1. Terms of Services

The program will include:
Nutrition and Exercise Programme specific to Client Needs as discussed in the Initial On Boarding Call. The program will consist of coaching, testing, plans/protocols and scientific analysis in these areas:

- Nutrition
- Exercise
- Sleep
- Stress Management
- Daily Routine

2. Use of Technology and App Platforms

A. The Client agrees to the use of the Executive Performance Health app platform to monitor progress throughout the program. Full participation in this platform is essential for achieving the quickest and most successful progress. The app will be used to track key metrics, set goals, and provide communication and feedback between the Client and the Coach. If the Client has any objections to the use of the app platform for any reason, they are required to inform the Coach during the onboarding stage of the program to explore alternative solutions.

B. The Client agrees to be guided by the Health Coach in the effective use of Oura™ wearable technology to optimize health outcomes. The Coach will provide instructions on how to utilize the Oura™ ring for tracking important health metrics such as sleep, activity, and recovery. The Client acknowledges that wearing the Oura™ ring consistently is essential for accurate data collection and achieving the best results within the program. This data enables the Coach to provide the most effective, tailored guidance and support.

C. The Client is responsible for covering the monthly Oura™ subscription fee and assumes full responsibility for any loss, damage, or theft of the Oura™ ring. The Oura™ ring, along with the sizing kit, will be supplied by XPC unless otherwise agreed upon. Any issues with the ring will be managed under the Oura™ warranty.

D. The Client agrees to allow the Coach access to their health data through the Oura™ Teams Business Platform for the duration of the program. This access is critical to enabling the Coach to monitor progress and provide actionable insights.

These tools - both the app platform and Oura™ wearable - are integral parts of the program and have been carefully chosen to maximize the Client's success. The Client's full engagement with these technologies, combined with guidance from the Coach, ensures the best possible outcomes from the coaching collaboration.

3. Investment & Refund Policy

Payment shall be made in full upon commencing the Program unless otherwise agreed upon by both parties, after which time a Payment Plan shall be issued to the client outlining the payment schedule (time, date and sum) of each instalment. In either case payment will be based on the agreed amount as per the coaching program and duration.

If a payment plan has been agreed upon, the client is expected to honour the payment schedule and ensure sufficient funds are available for each instalment. Instalments will be automatically processed using the payment details initially provided by the Client. Failure to make payment within three (3) days of the scheduled due date will result in the client's access to the Program and their coach being revoked until payment is received. We would ask that client’s avoid such situation if at all possible as we endeavour to avoid any disruption to your programme or comprise progress in any way.

XPC Graduate Program:
Upon completion of the initial coaching program, the Client will be offered the option to continue into the XPC Graduate Program at exclusive, discounted graduate pricing. Available renewal options and pricing will be communicated by the Client’s coach prior to the end of the initial coaching term.

Refund Policy:
We offer a 30-day refund policy on our programs under specific conditions. Refunds will not be granted due to personal circumstances or lack of participation. A refund will only be considered if the client demonstrates that the coaching program is not appropriate for their needs, despite having followed all instructions and guidelines exactly as provided. This includes attending scheduled calls, completing detailed weekly check-ins, and actively working toward the targets set by the coach.

This policy is in the best interests of both the client and the coaching team, as it ensures a fair and balanced approach to our collaboration. Our entire coaching team is committed to the client’s success and works diligently to support a positive and transformative outcome for everyone involved. We ask that all Clients embark on their coaching programme with their full enthusiasm and do everything within their power to hit all targets set by the coach. This includes booking calls, reviewing video feedback, responding to emails as soon as possible and wearing the Oura Ring. Failure to do so will negate the 30 day refund policy.

The 30-day refund policy also applies to any spouses or partners who join the program at a different time, starting from their individual sign-up date and receipt of their first payment.

Please note that the 30-day refund period begins immediately upon sign-up to the program and receipt of the first payment.

In the rare event that a refund is granted, a deduction will be made from the original investment to cover costs incurred, including but not limited to the Oura Ring, resources, and allocated coaching time. The amount of the deduction will be determined at the sole discretion of the founder.

In the unlikely event that a client requests a refund, the refund will be processed within three (3) days of the request and made available to the client within 5-10 working days after the issue date.

4. Communication and Health Assessments:

Being attentive to my clients is a priority. The Client and Health Coach may communicate via email, SMS, or phone as needed, with availability for communication 24/7.

Each week, the Client will receive a health assessment report detailing progress over the past 7 days, based on the goals and targets set. Adjustments to the Client's plan will be made as necessary, based on the data gathered. It is the Client's responsibility to review video feedback and respond to emails as soon as possible. Failure to do so may result in missed guidance on necessary adjustments, which could impact their ability to achieve success in the programme.

Bi-weekly meetings will be held via Zoom to review the Client’s feedback on current health plans and protocols, with the aim of creating a sustainable lifestyle. During these meetings, upcoming events (e.g. jet lag, hotel gym availability, vacations) will be discussed, and specific protocols will be created to ensure continued progress despite travel or life events.

Expectations

I expect that you will:

• Show up for every call without distractions.

• Use your best efforts to complete all actions steps.

• Make this program a top priority in your life.

• Understand that the power of coaching can only be granted by you.

• Commit to make this relationship powerful by communicating openly and doing the work.

Coaching Calls & Scheduling Policy:

Coaching calls play a vital role in our health and wellness program, providing valuable guidance and support. To ensure their effectiveness, we kindly request your full cooperation in maximising the potential of these calls. Please take note of the following:

A. Scheduling: When booking coaching calls, please select a time that you know will work well with your schedule. This will help ensure that you are fully present and able to actively engage during the call.

B. Punctuality: It is essential to arrive on time for your coaching calls. This demonstrates respect for both your own time and the time of your coach. Being prompt allows for a focused and productive session.

C. Active Participation: During the coaching calls, we encourage you to actively engage by asking questions, seeking knowledge, and sharing any concerns or challenges you may be facing. Your participation will help tailor the program to your specific needs and enable you to make the most of each session.

D. Feedback: We value your input and encourage you to provide feedback during and after coaching calls. Your insights are essential for us to continuously improve the program and ensure it meets your expectations.

E. Should calls be cancelled or rearranged by either party, we ask a minimum of 24 hours is given by either to allow alternative arrangements to be made. Please give your coach as much warning as possible should you need to change your coaching call; we will always endeavour to be as flexible around your needs as possible but we ask that you also respect our time

5. Intellectual Property Rights

I retain all ownership and intellectual property rights to the program content and materials provided to you through the program. The program content and materials are for your individual use only. You are not allowed or authorised to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the program or program materials, electronically, or otherwise, for business or commercial use, or in any other way without my prior written permission. Failure to follow the above guidelines will result in termination of contract with no refund.

6. Marketing

Should you tag or name me in any social media or marketing material I reserve the right to request that you remove the content. You agree that I can use images of our work undertaken for my own marketing and social media content. If you do not wish such content to be used please make the me aware in writing.

7. Personal Responsibility and Assumption of Risk

You acknowledge that you take full responsibility for yourself and all decisions made before, during, and after your program. You accept full responsibility for your choices, actions, and results before, during, and after this program. You knowingly assume all of the risk of the program related to your use, misuse, or non-use of the program or any of the program materials. You understand and agree that you are solely responsible for your results.

In the unlikely event that the Client sustains an injury during the course of the program—whether related or unrelated to the recommended physical activity—the coaching relationship shall continue without interruption. The Coach and Client will collaboratively adjust the focus of the program to support recovery and maintain momentum in other key areas of health, including but not limited to: rehabilitation guidance, optimized nutrition, stress management, sleep quality, and overall lifestyle strategy.

The Client acknowledges that formal exercise constitutes only a small portion of the comprehensive coaching methodology provided by the Company. As such, an injury does not inhibit long-term progress or the value of the program. Continued participation will remain aligned with the Client’s evolving needs and goals, ensuring a supportive and adaptive approach throughout the recovery period.

8. Disclaimer

I have used exceptional care in creating the information provided to you, but this program and the program materials are being provided to you as self-help tools for your own use and for information and educational purposes only. There are many factors that may influence your results to the program, and therefore, no guarantees can be made as to the results you will experience through this program. You agree that I am not responsible for your physical, emotional, mental, and spiritual health, or for any other result or outcome that you may experience through this program. Nothing related to this program is intended to be considered medical, mental health, legal, financial, or religious advice in any way

Acknowledgment of Terms:

By ticking the 'Terms and Conditions' box on the Executive Health Coaching App, the Client formally acknowledges that they have read, understood, and agreed to all of the terms outlined in this Agreement. This acknowledgment is considered legally binding and enforceable.

The Client further agrees that they have had the opportunity to ask any questions prior to agreeing to the terms, and their acknowledgment via the app indicates full acceptance of all the terms of this Agreement.

Electronic acknowledgments provided through the app replace the need for physical or signed agreements and carry the same legal validity.
